The operatives of the Department of State Service(DSS) believed to have come from the Ogun State Command of the DSS on Monday, May 13, allegedly stormed the premises of a state high court sitting in Ilaro, the headquarters of Yewa South Local Government Area of the state and arrested two persons
.
The two – Alhaji Isiaka Fatai and Samuel Oyero, were bundled out of the court premises, allegedly, in flagrant disobedience to the order of the Court and the age of Alhaji Fatai – and taken away after they were also beaten up.
The two were in court on Monday over matters pertaining to suit No HCP/IC/2023 to wit: The State vs Awode Oladosu & 13 others, which is before Justice A.A. Shobayo.
The case bordered on an allegation of arson reported by one Chief Akeem Adigun (aka Socopao) in which Alhaji Isiaka Fatai, Oyero and 12 others had appeared on Monday as defendants before the ugly scenario unfolded.
In a statement by their lawyer, Kehinde Bamiwola Esq, he alleged that the men of the DSS operatives used weapons on the two, stressing that “Alhaji Isiaka Fatai was beaten, slapped, man-handled, rough-handled and molested publicity to the extent that one of the Court’s staff telling them to obey the order of the court by desisting from carrying out any arrest within the court premises was hit, molested and wounded in facie curiae (meaning- in the face of the court).”

The men of DSS came to the High Court Premises of the Ogun State High Court, Ilaro Division, today, 13th day of May, 2024, where there was an on-going proceedings/trial in Suit No HCP/IC/2023, The State vs Awode Oladosu & 13 others; The Case was an allegation of arson reported by one Chief Akeem Adigun (aka Socopao) in which his lordship, Hon. Justice A. A. Shobayo was hearing before the ugly and commando-style invasion of the Court by the DSS. All the Defendants were present in Court; the case proceeded in its further hearing and was later adjourned to the 1st day of July, 2024. However, before the case was adjourned, the judge specifically warned the two parties to desist from any act that may be inimical to the proceedings and the peace of Agosasa; Parties are to maintain status quo as the Court will not take it lightly with anyone that violates the directive or order of the Court to maintain peace, said, the Judge hearing the case.One of the Counsel to the Defendants, Kehinde Bamiwola Esq, informed the Court that, he had earlier noticed the presence of the Men of the DSS within the Court premises and that he (Lawyer) had the fear that the Complainant, Chief Akeen Adigun (aka Socopao) has ignited and set the machinery of the state on motion by bringing the men of the DSS to Court to disrupt the proceeding and make unlawful arrest. His lordship, on that information ordered the State Counsel one Timilehin Oredehin to invite the Men of the DSS to the open Court. Their leader or team leader, was warned and ordered to leave the Court premises and that, if at all anyone is to be arrested, it should not be within the Court premises as they (DSS) know the houses of their targets or suspects to be arrested.The men of the DSS after leaving the Court’s hall went out within the Court’s premises, flouted, disregarded and violated the order of the Court by forcefully arresting, Alhaji Fatai Isiaka and One Samuel Oyero; it took the smartness of the driver to Alhaji Saheed Olabisi to escape the illegal and unconstitutional arrest within the Court premises, notwithstanding the order given by his lordship, Hon. Justice A.A. Shobayo.The men of the DSS used sophisticated weapons in a commando-style and on the instruction of Chief Akeem Adigun whisked away the duo of Alhaji Isiaka and Oyero, in flagrant disobedience to the order of the Court.Not minding the age of Alhaji Isiaka Fatai, he was beaten, slapped, man-handled, rough-handled and molested publicity to the extent that one of the Court’s staff telling them to obey the order of the court by desisting from carrying out any arrest within the court premises was hit, molested and wounded in facie curiae (meaning- in the face of the court).Recall that, the apex court has warned in Odumegwu Ojukwu V Attorney General of Lagos, that, executive lawlessness and the gross violation of the rule of law shall not be condoned anywhere; here we are under a democratic government that, men of the of State Security Services otherwise known as DSS will be using the toga of the State to commit atrocities, impunity, contempt of Court in the face of the Court itself and be doing as if they are above the law.The question is ‘’where is justice and respect for the rule of law in Nigeria?The whole world should come to the aid of the common-man, so that the era of brutality, Self-help, abrasion, lack of respect for fundamental human rights and day light impunity in this county can be checked before it manifests a hydra-headed epidemic that may even consume the administrators of the justice itself. It appears no one is safe in this country again. We urge the media family to help in making this impunity known to the whole world as the common man may lose interest in coming to Court and resort to self-help which may return our society to the brutish, nasty and an ill-regulated society which will not be safe for anybody.
